Delhi belongs to the migrants; High Court gave an important decision on reservation in the capital

The Delhi High Court recently said that being a Union Territory, the national capital belongs to migrants and the benefit of reservation cannot be denied to any category. A bench of Justice Suresh Kumar Kait and Justice Girish Kathpalia said, ‘There is no dispute that, NCT Delhi is a Union Territory for all purposes except running the administration, it belongs to migrants and hence no category can be denied the benefit of reservation.’

According to a report by Live Law, the court made this remark while dismissing the petition filed by the Delhi Subordinate Services Selection Board (DSSSB). The petition challenged the order of the Central Administrative Tribunal (CAT). CAT had directed that Vishnu Kumar Badetia is entitled to be appointed to the post of staff nurse in the health department of the Delhi government. He had applied as a Scheduled Caste candidate in the recruitment released in 2009.

Badetia was declared successful in 2011, but his name was not in the final list of appointment. He gave the reason for this that his caste certificate is from Rajasthan, which is outside Delhi. The candidate said that according to the letter issued by the Delhi government, SC / ST candidates are entitled to the benefit of reservation for civil posts in GNCTD, no matter where they are from. He also cited an earlier order passed by CAT. In a similar case in 2011, CAT had ordered to give appointment to some candidates as SC candidates.
