Due to child marriage, the option of choosing life partner is lost, Supreme Court comments – Hindustan News Hub

Supreme Court’s strict comment on child marriage

The Supreme Court has expressed strong displeasure over the issue of child marriage taking place in the country. The Supreme Court on Friday made a strong comment saying that the Child Marriage Prohibition Act cannot be circumvented through personal laws. The court also said that marriage related to children is a violation of the free will to choose a life partner of one’s choice. This eliminates the option of choosing a life partner of their choice.

Court issued guidelines

Delivering its verdict on a PIL alleging increase in child marriage in the country, the Supreme Court issued several guidelines for effective implementation of the law on prevention of child marriage. A bench of Chief Justice of India DY Chandrachud, Judge JB Pardiwala and Judge Manoj Mishra has issued these guidelines for effective implementation of the Child Marriage Prevention Act in the country.

Prevention of child marriage and protection of minors

CJI Chandrachud said that the Child Marriage Prevention Act cannot be disrupted through personal law. The court’s guidelines said that such marriages are a violation of the free will of minors to choose their life. Authorities should focus on the prevention of child marriage and the protection of minors and punish offenders as a last resort.

There are some flaws in the Child Marriage Prevention Act – Court

The bench also said that there are some flaws in the Child Marriage Restraint Act. The Prohibition of Child Marriage Act, 2006 was enacted to prevent child marriage and ensure their eradication from the society. This Act replaced the Child Marriage Restraint Act of 1929.

Strategy should be made for different communities

The bench said, ‘This strategy should be made for different communities. The law will be successful only when there is multi-sectoral coordination. There is a need for training and capacity building of law enforcement officers. We emphasize that a community-driven approach is needed.
