9 decisions came after the retirement of HC judge; Supreme Court also surprised by this, sought a report

A judge of Madras High Court gave judgments after retirement, on which the Supreme Court has summoned a report. The detailed judgments of High Court Justice T. Mathivanan have been released on the High Court website after his retirement. The apex court has raised questions regarding this and has sought a report. The bench of Supreme Court Justice Abhay S. Oka and Justice Augustine George Masih has summoned complete information from the Registrar of the High Court. The court has asked when the one-line judgment of the relevant decision came. After this, when was the detailed order uploaded.

According to Bar and Bench report, the Supreme Court gave this order while hearing the CBI’s petition against the dismissal of the DA case. This is not the first case when questions have been raised about Justice Mathivanan’s behavior. He retired in May 2017. Earlier, the Supreme Court had rejected a decision of Justice Mathivanan. The reason for this was that the detailed copy of the decision given by Mathivanan was uploaded on the website 5 months after his retirement.

Today the court was informed that apart from the present case, there have been about 9 such judgments of Justice Mathivanan, which were uploaded after his retirement. Taking cognizance of this matter, the Supreme Court strongly objected and issued a notice to the Registrar of the High Court. The court has asked why this happened. When were the initial copies of the judgments issued and then when were the detailed judgments issued. The court asked when were the single line orders passed and when were they uploaded in detail. The bench asked whether any administrative order was issued by the Chief Justice of Madras High Court regarding such 9 cases.
