Big blow to Punjab government from Supreme Court, matter related to BSF

Shock to Punjab government from Supreme Court.

On Friday, the Punjab government got a big blow from the Supreme Court. The Supreme Court has upheld the decision of the Central Government to increase the jurisdiction of the Border Security Force. The court has said that the decision to increase the jurisdiction of BSF has not encroached on the powers of Punjab Police. Along with this, the court has also advised both the parties to sit together and discuss.

What is the matter?

In fact, in the year 2021, the Central Government had decided to increase the jurisdiction of BSF from 15 kilometers to 50 kilometers from the International Border. Let us tell you that there is a provision for BSF officers and soldiers to take action of search, seizure and arrest in the border areas. This decision of the government was opposed by the governments of Punjab and West Bengal at that time.

What did the court say?

Hearing the matter, a bench of Chief Justice DY Chandrachud, Justice JB Pardiwala and Justice Manoj Mishra orally said that the central government’s decision did not encroach on the powers of the Punjab Police. The court also said that the authority to investigate has not been taken from the Punjab Police. The court asked Solicitor General Tushar Mehta, representing the Centre, and advocate Shadan Farasat, representing the Punjab government, to sit together and jointly decide on the issues on which the bench has to decide.

What will happen next now?

As per the direction of the court, both the parties will hold discussions among themselves so that these issues can be resolved before the next date. The court has said that the Advocate General of Punjab can participate in this meeting. The Chief Justice said prima facie the matter was that there were concurrent powers which could be exercised by both the BSF and the state police. (input language)
