Delhi High Court made special remarks regarding POCSO Act, granted bail to the accused

Delhi High Court On POSCO Act: Delhi High Court has made an important comment regarding ‘POCSO Act’. The Delhi High Court observed that the purpose of the POSCO Act is to protect children from sexual exploitation and not to criminalize consensual relationships between young adults. However, the court also said that it is also very important to keep in mind the facts and circumstances of each case, as in many cases the victim can also be pressured to compromise.

Court granted bail to the accused youth

In fact, the Delhi High Court has made this remark while granting bail to the juvenile arrested under the POCSO Act. The arrested juvenile was accused of forcibly having sex with a 17-year-old girl by marrying her. While granting bail to the arrested juvenile in this case, the court said that in this case the girl was not forced to have a relationship with the boy. Referring to the girl’s statement, the court said that there was a romantic relationship between the two and both had consensual sex.

The court, while giving its verdict, said that the purpose of the POCSO Act was to protect children below the age of 18 years from sexual exploitation. It was never intended to criminalize consensual romantic relationships between underage adults. The Delhi High Court further said in its remarks, however, that each case should be considered on the basis of facts and circumstances. There may also be cases in which a victim of sexual abuse may be compelled to compromise due to some pressure.

What is the whole matter?

The family got the girl married on 30 June 2021 at the age of 17. The girl was not happy with her marriage and did not want to live with her husband. So the girl ran away from the house and got married with the accused youth. The girl and the accused youth got married on 28 October 2021.

After this, the family members of the girl filed a case against the accused youth. The police registered a case and arrested the accused youth under the POCSO Act. The court directed the accused to be released on bail on furnishing a personal bond of Rs 10,000 and a surety of like amount.
