Do not take action with bulldozer only if there is an accused; SC gave advice and Central Government gave reply

In many states of the country like Uttar Pradesh, MP, the trend of bulldozer action has increased in serious crimes like rape and riots. Bulldozer action has been taken many times on the unauthorized constructions of the accused. Meanwhile, on Monday, petitions filed in the Supreme Court against such action were heard. During this, the court said that how can someone’s house be demolished just because he is an accused. The Supreme Court said that even if a person is guilty, his house cannot be demolished without following the procedure prescribed by law.

Not only this, the court said that we want a guideline to be prepared in this case, which should be followed in the whole country. Along with this, the bench has decided to hear the case next on September 17. The bench said that we will decide the guidelines in this case. The bench said that even if a person is guilty, how can his house be demolished without following the procedure. However, the bench of Justice BR Gavai and Justice KV Vishwanathan also made it clear that we will not protect illegal construction. The Supreme Court said that we propose to set guidelines for the whole country.

Let us tell you that Mohammad Hussain of Madhya Pradesh and Rashid Khan of Rajasthan had filed a petition in the Supreme Court. While hearing this, the court said that we do not support illegal construction on roads and public places, but the action of bulldozer without proper procedure is not right. On this, Solicitor General Tushar Mehta, while representing the Central Government, said that it does not happen that the construction is demolished only after someone is accused or convicted. Mehta said that this happens only when the construction is illegal. Therefore, action is taken only after following the necessary procedure.
