Don’t use gun on my shoulder, I have nothing to do with politics but collegium system is bad: Justice Sodhi

New Delhi: Retired High Court Justice RS Sodhi, who questioned the collegium system, has said that the law minister should not use me for politics. Sodhi said that I am not a political person. In such a situation, do not bring me in the middle. As far as the collegium system is concerned, my objection remains on it. Also said that if a representative of the government is kept in it, then what is the problem in that. Government is not the enemy of anyone. In fact, in the midst of the Supreme Court Collegium vs Government controversy, on Sunday, Union Law Minister Kiren Rijiju shared the statement of retired Justice Sodhi, in which Sodhi questioned the Collegium system. Rijiju had said that this is a noble voice of a judge and the thoughts of most people in the country are full of such understanding.

Objected to the statement of the Law Minister
Former Justice Sodhi reacted sharply to the said statement of the Law Minister and asked the Law Minister not to use me in this matter. Justice Sodhi said in a conversation with NBT that my objection remains on the existing collegium system for the appointment of judges. I am against the collegium system, but you (law minister) don’t use me in your politics.

The government should not interfere in the collegium system
Justice Sodhi said that it is also being said that the government should not interfere in the collegium system. This thing is being said continuously. I believe that the government is not the enemy of anyone. If a representative of the government is kept in the collegium, then what is the problem in it. It is not necessary that BJP should remain in power forever, anyone can come in power. If any member comes on behalf of the government, he will present his case. There shouldn’t be any problem in this. If we look at the current Collegium, there are three members in the High Court Collegium and they decide who will be the Justice of the High Court. The same name goes to the Supreme Court Collegium and the selection of High Court Justices is decided by a three-judge collegium of the Supreme Court. I believe that if there is a representative sent by the government, then what is the problem?

There should be system and criteria for the appointment of judges
Also said that there should be a system and criteria for the appointment of judges. The requirement of minimum practice of 10 years alone should not be sufficient to become a High Court Judge. Other criteria should be fixed. There should be a secretariat, investigation should be done and the names of those who are better and meritorious should be listed. From that the name should be carried forward.
