Everyone has the right to choose their gender, Rajasthan High Court’s decision

Jodhpur. The Rajasthan High Court has said that people have the right of self-determination to choose their gender. People have a fundamental right to self-identify their personality, sex or gender identity. A single bench of Justice Anoop Kumar Dhand gave this decision. Observing this in an order dated May 25, he directed the authorities to consider revising the service records of the petitioner, a man whose gender was determined at birth to be female.

The High Court order said, ‘Gender identity is the most fundamental aspect of life which refers to the intrinsic value of a person to be male or female. Everyone is entitled to enjoy all human rights without discrimination on the basis of sexual orientation or gender identity which is a basic requirement for survival.
