New Delhi. There has been an increase in the death sentence given by the courts in the country. The trial court has awarded death sentence to 165 people in the year 2022. Which is the highest number of death sentences in a year in the last two decades. And in the year 2021, 146 prisoners were sentenced to death. The shocking thing is that in the death sentence given by the court, one-third of the cases are related to sexual crimes.

According to a TOI report, from the year 2015 to 2022, there has been a 40 percent increase in the death penalty in the decisions given by the court. The reason for the increase in death penalty could be the large number of death sentences awarded by the trial courts and the disposal rate of such cases by the appellate courts. The findings are part of ‘The Death Penalty in India: Annual Statistics 2022’ published by Project 39A at NLU Delhi.

38 sentenced to death in a 2008 case
In February 2022, 38 people were sentenced to death by an Ahmedabad court in the 2008 serial blasts case. At the same time, in the year 2016, it reached 165 in the year 2022 as against 153 cases of death sentence. Anoop Surendranath, law professor and executive director of Project 39A, says the increased numbers also reflect a growing trend in lower courts.

He said that since the decline in the year 2020 due to the pandemic, trial courts have resumed a large number of death sentences, which were the lowest at 77. Surendranath further said that this is in stark contrast to the efforts of the Supreme Court to highlight the serious problems in the manner in which capital punishment is administered. It may be noted that last year, the Supreme Court had issued a guideline regarding the award of death sentence by the trial court and the High Court. The Supreme Court had said that before awarding the death sentence, the trial court should see under what circumstances the crime took place and what is the background of the criminal.
