‘Officers do not listen at the behest of Lieutenant Governor’, Delhi government claimed in affidavit filed in SC

Delhi Deputy CM Manish Sisodia has filed a new affidavit in the Supreme Court amid the war over rights and functions. In this affidavit, Manish Sisodia has made many serious allegations on the work of LG and officers. It has been said in this affidavit that the bureaucrats have stopped even participating in the meetings.

Officials do not even receive phone calls of ministers. The orders of the minister are also being continuously ignored and the elected government is being treated with indifference. It has been said in the affidavit that ever since Vinay Kumar Saxena was appointed as the new Lieutenant Governor in Delhi at the beginning of the year, the difficulties of the elected government have increased.

Posts are lying vacant in Delhi Government
The Delhi government has said in its affidavit that the posts of many departments of the Delhi government are lying vacant on a large scale. He said that those who have the responsibility of filling these posts are not accountable to the public. The government has said in its affidavit that senior officers of different departments have been continuously transferred, due to which there has been a huge gap in implementing the policies of the government. This affidavit filed by the Delhi government will now be heard in the Constitution Bench on November 24.

Before this, when has the Delhi government raised questions?
This is not the first time that the Kejriwal government has raised questions on the new Lieutenant Governor of Delhi Vinay Kumar Saxena. Before this, many such occasions came to the fore when the government and the LG’s tussle has been openly visible. Actually it started when LG called a meeting of Jal Board officials without informing the minister.

After this, the LG refused to approve the proposal of Chief Minister Arvind Kejriwal to visit Singapore and argued that the program is not of the CM level, it is of the Mayor level, so the CM should not participate in it. What steps did the Delhi government take on the excise policy?
The Lieutenant Governor’s government, raising questions about the excise policy, has ordered an inquiry into it and handed over the investigation to the CBI after it was found to be wrong. After this, the LG also submitted the recommendation of the ongoing investigation in the case of alleged scam during the tender process for the purchase of 1000 low floor DTC buses on the Kejriwal government to the CBI. However, during this, the Delhi government accused the LG and said that Delhi needs a more educated LG. The current LG doesn’t even know where he is signing.

What questions did you raise about LG?
The LG of Delhi raised questions about the Aam Aadmi Party. AAP accused the LG and said that LG Vinay Saxena, while the chairman of Khadi Village Industries Commission, committed a scam of Rs 1400 crore. During this, he gave the contract to his daughter without tender. Whereas after this allegation, LG filed a defamation case against all the AAP MLAs who made these serious allegations against them. Even after this, this war did not end here, but the LG has ordered an inquiry to the Chief Secretary on the allegations of corruption in the recovery of water bills.

After this, this fight became openly known when the LG wrote a letter to Chief Minister Arvind Kejriwal with strong remarks and accused the government of saying that the Delhi government is running on the basis of advertisements and speeches. After which Delhi Chief Minister Arvind Kejriwal took a jibe at this letter and said that this is a love letter written to him by the LG.

LG stopped many files of Delhi government
When the dispute escalated, the LG withdrew the file related to the Delhi government’s red light on-cart off campaign to reduce pollution, stating that they received the file late by the government and also mentioned the benefits associated with this campaign. File not done. Against which the Kejriwal government came out on the road and said that the LG is deliberately stopping their work.

After this, the LG also stopped the file related to the program ‘Delhi Ki Yogshala’, another scheme of the Delhi government. After which the government had to stop this program from November 1, although on this, CM Arvind Kejriwal, while counting the benefits of yoga, said that people have benefited a lot from it and they will not let it stop, even if they themselves should not bear the entire cost. After which this program started again in Delhi.

This is not the first time that the Kejriwal government with the LG of Delhi has been embroiled in such controversies. Even before this, all the LGs during the government were accused by the Kejriwal government that the LG is forcibly stopping their work and this is happening because the BJP government at the Center is getting their work stopped through the LG.

When and where did the dispute between the LG and the Delhi government happen?

1- Since the year 2015, Kejriwal has been continuously attacking the Lieutenant Governor. He even complained that the Chief Minister does not have the right to transfer even the peon posted in his office.

2- In December 2015, the officers went on a day’s leave against the suspension order of two special secretaries of the government.

3- There was also controversy over the proposal of the Delhi government to install CCTV cameras. The Lt Governor had returned the proposal to the Delhi government, recommending necessary changes.

4- After this the demand of the Chief Minister was that the Lieutenant Governor should approve the door step delivery scheme. The CM had alleged that the Lieutenant Governor’s behavior is like that of the Viceroy, he does not even have time to meet the Chief Minister.

5- Najeeb Jung appointed Joint Commissioner of Delhi Police MK Meena as the new chief of ACB. Kejriwal strongly opposed this decision.

6- Lieutenant Governor Najeeb Jung, using veto power, removed Dharampal, the Home Secretary of the Delhi Government.

7- Delhi government appointed Swati Maliwal as the chairperson of Delhi Commission for Women (DCW). Najeeb Jung asked – why was his approval not taken.

8- CBI raided the Chief Minister’s Office. Kejriwal had blamed Prime Minister Narendra Modi and Najeeb Jung for this.

9- On the orders of the LG, the ACB had registered an FIR against Arvind Kejriwal and former Delhi Chief Minister Sheila Dikshit in the water tanker scam.

10- Najeeb Jung fired Delhi’s Health Secretary and PWD Secretary. On this, Kejriwal had said that PM Modi wants to destroy Delhi through war.

11- The dispute between Najeeb Jung and the Kejriwal government had increased when Najeeb Jung alleged that during a meeting at Arvind Kejriwal’s residence, some MLAs scuffled with him and the matter reached the court.

12- Even during former Lieutenant Governor Anil Baijal, this quarrel had increased so much that Chief Minister Arvind Kejriwal, Deputy Chief Minister Manish Sisodia and Minister Satyendar Jain sat on a dharna inside the LG office for almost a week over a matter related to CCTV.

13- During this dispute between the Lieutenant Governor and the Kejriwal government increased so much that the matter reached the Supreme Court from the High Court. The court then said in its decision that the Lieutenant Governor does not have independent authority to take decisions, he is bound to follow the advice of the government.

‘Governor’s intervention is justified’
BJP and Congress have also been continuously raising questions on these disputes between the Kejriwal government and the Lieutenant Governor. Both the parties said that in this way the development work of Delhi gets hampered. Now that once again this war has intensified, BJP MP and National General Secretary Dushyant Gautam said that the Governor is sitting on a constitutional post and follows the limits of the Constitution. And in such a situation, if the governor feels that the state government is ignoring the dignity of the constitution, then the intervention of the governor is justified.

Dushyant Gautam said on the ongoing dispute between the CM of Delhi and the Lieutenant Governor that the Delhi government constantly does such things which are against the rules and the constitution, there is not one but many problems in Delhi in today’s date and when the lieutenant governor no one is concerned about those problems. Talking about it, the Delhi government does politics on it because it does not approve of it.

What did Congress say?
The Congress also raised questions on the Arvind Kejriwal government and said that this government only works to make excuses. Delhi Congress vice-president Mudit Agarwal said that if there is any dispute, then the Lieutenant Governor and Arvind Kejriwal should sit together and resolve that dispute. Because in this way the development work of Delhi has come to a halt, due to which the people of Delhi are also upset.
