New Delhi: The Supreme Court has taken a big decision in the note-for-vote case. The Supreme Court has rejected the previous decision. The court has said that we do not agree with the previous decision. Now there is no immunity from arrest in bribery case. The Supreme Court said that parliamentary privilege is not applicable to taking bribes.
What is the whole matter?
The matter is that if MPs take money to vote or make speeches in the House, a case will be filed against them. They will not be able to get any exemption in this case. In fact, in 1998, a Constitution bench of 5 judges had decided with a majority of 3:2 that public representatives cannot be prosecuted in such a case. The Supreme Court has overturned this decision.
This clearly means that if any MP or MLA takes bribe for voting in the House, he will be prosecuted. He will not be able to escape action.
What did the Chief Justice say?
During the hearing, the Chief Justice said that we took a decision on all aspects and considered whether MPs should be exempted from this? We disagree with this. That is why we reject it with majority. He said that we have rejected the verdict in P Narasimha Rao case.
