SC will now hear on November 29 on Gujarat government’s decision to release 11 convicts

Bilkis Bano Case: The hearing on the PIL filed in the release of convicts in the Bilkis Bano gangrape case has started. In response to the PIL filed in this matter, the Government of Gujarat had filed its affidavit on Monday. In this hearing on Tuesday (October 18), the petitioner has sought more time. The next hearing related to this matter will be on November 29.

In the affidavit filed in the SC on Monday, the government had said that the 11 accused in the Bilkis rape case have been released keeping in mind the Supreme Court’s order and permission was also taken from the central government in this case before their release. The Gujarat government said that the behavior of the convicts in the jail was good.

What did the Gujarat government say in SC?
The state government has told that on May 13 this year, the Supreme Court had ruled that the old policy made in 1992 for the release of these people would be applicable. That policy provides for release from life imprisonment after spending 14 years in jail. All these people have been in jail for more than 14 years. His conduct in jail has been good. Therefore, they were released after following the necessary legal process.

While opposing the filing of PIL in this matter, the Gujarat government has said that it is an abuse of law. The law does not give any outsider the right to interfere in a criminal matter.

‘Fundamental rights not being affected’
The Gujarat government had said that no fundamental right of Subhashini Ali and other petitioners is being affected in this case, so that they can file PIL. The petitioners have links with political parties. He has leveled wrong allegations against the state government. It has even been said that these people have been released under the program ‘Azadi Ka Amrit Mahotsav’. Whereas, the release has been done by following the entire legal process as per the order of the Supreme Court.

What is the matter?
The convicts in the Bilkis case were released on 15 August. CPM leader Subhashini Ali, social activist Rokhine Verma, Revathi Lal and Trinamool Congress leader Mahua Moitra filed petitions in the Supreme Court seeking quashing of the Gujarat government’s order related to this release. On August 25, a bench of the then Chief Justice NV Ramana, Justices Ajay Rastogi and Vikram Nath had issued a notice on this. The court said to hear the matter after 2 weeks.
