1. Decision regarding divorce

The court said in its decision that a waiting period of 6 months will not be necessary for divorce by mutual consent. The court said that in such cases where there is no possibility of the husband and wife living together, he can divorce on his own behalf using the special powers given under Article 142. In cases where both the spouses agree to the divorce or even if one of the spouses does not consent to the divorce, the Supreme Court can order divorce. This decision clearly meant that waiting for 6 months for divorce would not be mandatory.

Validating the Central Government’s decision to remove Article 370 from Jammu and Kashmir is one of the important decisions of the Supreme Court in 2023. On October 17, the court gave a major decision regarding the marriage of gay couples. The court refused to give legal validity to such couples. This decision was given by a bench of five judges headed by Chief Justice DY Chandrachud. The bench delivered the verdict with a majority of 3-2. 4. Formation of committee in Adani-Hindenburg case

The Adani-Hindenburg case made headlines across the country. On March 2, the Supreme Court had constituted an expert committee on the questions raised by the Hindenburg Research report on Adani group companies. The committee consisted of 6 members headed by former apex court judge Justice AM Sapre. The apex court had then asked SEBI to file a status report within 2 months. The Supreme Court was at that time hearing petitions related to the Hindenburg Report, including the formation of a committee related to the regulatory mechanism to protect the interests of investors.
