Under the US Immigration Law, the US issues immigration visas to about 1 lakh 40 thousand foreign nationals every year. This immigrant visa is given every year from 1 October to 30 September. Employment Based Immigrant Visa is divided into five categories E-1, E-2, E-3, E-4, E-5.
Employment First Preference (E1)
The E1 visa is reserved for priority workers and individuals of exceptional ability. Science, arts, education, business, professors and researchers, multinational executives and managers come under this category. Professors and researchers should have at least 3 years of experience in teaching or research, which is recognized internationally. Labor certificate is not required for this immigration visa.

Employment Second Preference (E2)
Applicants with the second preference should generally have a Labor Certificate approved by the Labor Department. Professionals with advanced degrees or exceptional ability in science, arts or business are placed under the E1 visa category.
Employment Third Preference (E3)
Applicant applying under Employment Third Preference E3 must have an approved Immigration Petition for Foreign Employee, Form I-140, filed by the prospective employer. Skill labor, professional and other workers have been kept in this category.
Employment Fourth Preference (E4)
The Employment Fourth Preference is reserved for ‘Special Immigrants’. This includes certain religious workers, employees of US Foreign Service positions, retired employees of international organizations, non-citizen minors who are wards of courts in the United States, and other classes of non-citizens.
Employment Fifth Preference (E5)
Applicants under the Employment Fifth Preference are non-resident investors. Investors who invest $1.5 million or $800,000 in a new commercial venture employing at least 10 full-time American workers.
