According to the information, the main court of Colorado state declared him ineligible for the post of President under the US Constitution on Tuesday in the Capitol violence case.

This section of the Constitution has been used for the first time for disqualification from the post of President.

In this way, the court has removed Trump, the main contender for the White House race from the Republican Party, from the presidential primary voting. This is the first time in the history of America that Section 3 of the 14th Amendment has been used to disqualify a presidential candidate. The Colorado High Court, in its 4-3 majority decision, said, the majority of the court believes that Trump is ineligible to hold the office of President under Section 3 of the 14th Amendment.

All the judges of the court were appointed by the Democratic Party

According to media reports, all the judges of the American court which has given the decision for former President Trump were appointed by the governors of the Democratic Party. The High Court of Colorado State gave this order, overturning the decision of the District Court judge. The lower court had said that Trump had incited the mob to violence for the attack on Capitol Hills (US Parliament) on January 6, 2021. But the court had also said that Trump cannot be barred from participating in the presidential elections for this reason. Because it is not clear that section of the Constitution covers the presidency.

High Court stayed its decision

The High Court stayed its decision till January 4 or until the US Supreme Court decides on the case. With this decision, it will now be challenging for the US Supreme Court to decide whether Trump can remain in the nomination race from the Republican side.
