Shock for those who perform gay marriages in Japan, High Court gives big decision – Hindustan News Hub

Tokyo: The High Court has given a big decision regarding gay marriages in Japan. This decision has dealt a big blow to gay couples. Another high court on Wednesday declared the government’s policy banning gay marriages unconstitutional. The Tokyo High Court said the ban on gay marriage is “a baseless legal discrimination based on a person’s sexual orientation”.

She said the ban violates the right to equality as well as the dignity of individuals and constitutional guarantees of gender equality. Earlier, a Sapporo High Court ruling in March said not allowing gay couples to marry and enjoy the same benefits as civil couples violates their fundamental right to equality and freedom of marriage. The Tokyo High Court on Wednesday became the seventh court in Japan to rule that the current ban on gay marriage is unconstitutional or similar. Only one district court in the country has declared the ban on gay marriages constitutional. However, these orders can be challenged in the Supreme Court.
