Delhi High Court has banned the sale of generic medicines. Actually, the court has banned the generic medicine for cancer. After all, why has this decision been taken? The court has banned the generic version of the medicine of 6 Indian pharmaceutical companies namely Natco Pharma, Hetero, BDR Pharma, Shilpa Medicare, Alkem and Laurus Labs. This decision was taken because this pharmaceutical company was violating the rules of drug patent. The patent for Ibrutinib is held by Pharmaceuticals, a co-company of American company AbbVie. This medicine is sold in India by Johnson & Johnson (which is the Indian subsidiary of Janssen Biotech).
In which cancer is this medicine used?
In its recent decision, Delhi High Court has banned the generic version of Ibrutinib, a drug used in the treatment of leukemia i.e. blood cancer. This has been done because its patent rules are being violated. After the ban of this medicine, there are speculations that patients will no longer be able to get cheap medicine.
Ban on cancer drug Ibrutinib
The patent of cancer drug Ibrutinib was till the year 2026. The generic version of the cancer drug was being sold under the registered trademark of Imbruvica. According to Justice C Hari Shankar, some pharmaceutical companies are manufacturing and selling Ibrutinib without licenses. This medicine is used in cancer as well as other diseases. Whenever a patent is infringed, the law will tighten its grip on it. This decision has been taken after 6 cases. A writ petition was filed (in a post-grant application filed by Laurus Labs) on the basis of which it was sought to be quashed. However, keeping in mind the need of the medicine, the company has been given permission to sell the medicine which is already in stock. But at the same time a condition was kept that he would present the complete details of the sale before the court.
