Medical Negligence: Doctor is considered like God on earth. But many times, if a patient dies due to medical negligence or carelessness, there is a provision for strict punishment for the doctors. Despite this, every day there are reports of patients’ family members assaulting doctors in some hospital across the country. An important news has come in this regard. In the Indian Criminal Code laws, the punishment for doctors has now changed if a patient dies due to negligence on the part of doctors. Earlier, if a patient died due to medical negligence, doctors were accused of culpable homicide. But in the recent changes in the judicial code, this punishment has been softened.
Home Minister Amit Shah got the bill passed
Let us tell you that Home Minister Amit Shah had recently passed some new bills related to the criminal justice system in the Lok Sabha. In this, the provision of punishment for death due to negligence of doctors has been changed. Now according to the new bill, if a patient dies due to medical negligence, then it will not be considered as culpable homicide and the jail sentence given to the doctor in this regard will also be less. In the earlier bill, in case of death of a patient, the doctor would have been accused of culpable homicide and there was a provision for a strict punishment of two years. The new law provides for a punishment of only two years.
Now doctors will not be accused of culpable homicide
It is being said that the Medical Association had written a letter to the Home Minister for changes in this bill regarding the death of a patient due to negligence of doctors. In this letter, an appeal was made to reconsider the punishment of doctors in the bill. The bill related to medical negligence is related to the Indian Judicial Code (Second) and there was a provision for jail sentence for doctors. The new Criminal Law Bill has been passed in the Lok Sabha and it is considered very beneficial for doctors.
