Approval of CBI investigation against Shivakumar illegal: Siddaramaiah

Bengaluru: Karnataka Chief Minister Siddaramaiah has filed a complaint against Deputy Chief Minister D.K. in the disproportionate assets (DA) case. Defended his Cabinet’s decision to withdraw permission for CBI investigation against Shivakumar. He said that the approval given by the previous BJP government was illegal. The state cabinet on Thursday had said that the previous Bharatiya Janata Party (BJP)-led government’s decision to give approval to the CBI to investigate Shivakumar in the disproportionate assets case was not in accordance with the law, hence it had decided to withdraw the approval. Has decided. Let us tell you that the BJP led government had approved it on 25 September 2019. After this, the Central Bureau of Investigation (CBI) filed an FIR against Shivakumar on October 3, 2020.

Approval was given illegally

The CBI claims that Shivakumar had acquired assets worth more than Rs 74.93 crore from his known sources of income from April 01, 2013 to April 30, 2018, when he was the Energy Minister in the then Siddaramaiah-led Congress government (2013-2018). Siddaramaiah told reporters here that we have said that the approval was illegal. Government’s approval is required for investigation against any person holding a government post. If he is a minister then the Governor should approve, and if he is an MLA then the Speaker of the Assembly should approve. Shivkumar was an MLA at that time, hence the permission of the Assembly Speaker had to be taken, which was not taken. He said that even before the Advocate General gave his opinion, the then Chief Minister B. S. On the basis of Yediyurappa’s verbal instructions, the Chief Secretary gave his consent to investigate the case by CBI and issued an order. He said that we have said that it (approval) was illegal because it was not in accordance with the law. He said that the approval was given illegally, this is not right, we will withdraw the approval, that is what we have said.

Will not comment on court decisions

Responding to a question, Siddaramaiah said he would not comment on the court’s decisions; The government will do whatever it has to do. We cannot hinder what the court decides, we cannot interfere. Let the court decide what to do. Meanwhile in Mangaluru, Urban Development Minister Suresh BS justified the state Cabinet’s decision to withdraw the permission given by the previous government for a CBI probe in the disproportionate assets case against Shivakumar. Speaking to the media on the occasion of inaugurating the newly constructed international swimming pool at Yemmekere under the Mangaluru Smart City project at a cost of about Rs 25 crore, Suresh said that the then Advocate General of the state had not given opinion in its favor and the Chief Minister had informed the Chief Secretary. Permission for investigation was given verbally. The Karnataka High Court on Wednesday adjourned till November 29 the hearing on the appeal filed by Shivakumar against the approval given by the previous government to the CBI to prosecute the disproportionate assets case.
