The Supreme Court has asked the Punjab government to respond to the plea of ​​the 61-year-old woman, who has been named in the case filed by her daughter-in-law. Now agreeing to review the issue, a bench of Justices Hrishikesh Roy and Sanjay Karol granted protection from arrest to the woman and directed her to cooperate in the investigation.

Court gave protection to woman from arrest

On this matter, the Supreme Court said, “Notice is issued.” This should be answered within four weeks. Meanwhile, the petitioner woman is granted protection from arrest. But they are expected to cooperate in the investigation of the crime.” At the outset, advocate Rishi Malhotra, appearing for the elderly woman, argued that section 376(2)(n) of the Indian Penal Code (IPC) (bar- Except the charge of bar rape), all other penal sections in the FIR are bailable. On conviction under this section, there is a provision of minimum imprisonment of 10 years and it can be extended up to life imprisonment.

What is the whole matter?

Citing a decision of the Supreme Court, the woman’s lawyer Malhotra said that no woman can be accused of rape. According to the case, the complainant daughter-in-law was initially in touch with the woman’s US-based elder son, but they had never met in person. The husband of the elderly woman has passed away. The FIR states that the complainant married the woman’s son in a virtual marriage ceremony and thereafter started living with the woman.

But later the woman’s younger son came to meet her from Portugal. The woman has claimed that after the arrival of her younger son, the complainant daughter-in-law and her family pressured her to end her marriage with her elder son. When the younger son was about to go to Portugal, the complainant’s daughter-in-law insisted that she take him with her, but he went alone.

Daughter-in-law accuses brother-in-law and mother-in-law of rape

According to the FIR lodged in the case, when tension increased between the two families, a compromise was reached and the woman gave Rs 11 lakh to the daughter-in-law to end her marriage with her elder son. The daughter-in-law then contacted the local police and lodged an FIR against the elderly woman and her younger son, leveling rape and other allegations.
