The Supreme Court will hear today i.e. Tuesday the petitions seeking direction to the Center to stay the implementation of the Citizenship Amendment Rules, 2024, until the apex court hears the case challenging the constitutional validity of the Citizenship (Amendment) Act. Does not decide on petitions. Since the CAA provision was passed in 2019, more than 230 petitions have been filed in the apex court on this matter.
Demand to ban notified rules
A bench of Chief Justice DY Chandrachud, Justice JB Pardiwala and Justice Manoj Mishra will hear the case. The Indian Union of Muslim League (IUML) had on March 12 filed a petition in the Supreme Court seeking urgent hearing to stay the Citizenship (Amendment) Act (CAA), 2019 and its rules notified by the government on March 11, 2024. . Lok Sabha MP and AIMIM chief Asaduddin Owaisi has also approached the Supreme Court seeking a stay on the implementation of the provisions of CAA.
Non-Muslim immigrants will get citizenship
The Home Ministry had notified the implementation of the Citizenship Amendment Act (CAA) rules on March 11. The law paves the way for Hindu, Sikh, Jain, Buddhist, Christian and Parsi refugees who came to India from Afghanistan, Bangladesh and Pakistan before December 31, 2014, to obtain Indian citizenship without a valid passport from these countries or an Indian visa.
IUML has filed a petition in the Supreme Court
A day after the Center issued rules under the CAA, Kerala political party Indian Union Muslim League (IUML) moved the Supreme Court seeking a stay on the implementation of the rules. IUML demanded that the controversial law and rules be stayed and no coercive action be taken against those from the Muslim community who are deprived of the benefits of this law. Apart from IUML, other parties and individuals like Democratic Youth Federation of India (DYFI), Leader of Opposition in Assam Assembly Debabrata Saika, Congress MP from Assam Abdul Khaliq have also filed applications.
These rules will not apply to some areas
The Citizenship (Amendment) Bill 2019 was passed in Parliament in December 2019. The Lok Sabha passed the bill on 9 December, while the Rajya Sabha passed it on 11 December. The amendments on citizenship for illegal immigrants will not apply to certain areas. These include the tribal areas of Assam, Meghalaya, Mizoram and Tripura included in the Sixth Schedule of the Constitution. CAA will not be applicable even in the states where ‘Inner Line Permit’ system is in force under Bengal Eastern Frontier Regulation 1873. The system of ‘Inner Line Permit’ is applicable in Arunachal Pradesh, Mizoram and Nagaland.
