Will there be a ban on CAA rules? Muslim League reached Supreme Court, said this in the petition – India TV Hindi

New Delhi: The Indian Union Muslim League (IUML) has filed a petition in the Supreme Court seeking a stay on the implementation of the rules notified by the Union Home Ministry under the Citizenship Amendment Act (CAA). In its petition, the Muslim League has said that the Citizenship Amendment Rules are arbitrary and give unfair advantage to a section of persons only on the basis of religious identity, which is a violation of Articles 14 and 15 of the Constitution.

IUML said, ‘…then their citizenship will have to be taken away’

The plea said that around 250 petitions challenging the provisions of the CAA are pending before the apex court and if the CAA is held unconstitutional, an unusual situation would arise. It has been said that in case this happens, those who would have got citizenship under the applicable Act and rules, their citizenship will have to be taken away. It said, “It is therefore in the best interest of everyone to postpone the implementation of the CAA and applicable rules until the Court decides the matter.”

CAA will remove legal obstacles for rehabilitation

The CAA paves the way for granting Indian nationality to non-Muslim immigrants, i.e. Hindus, Sikhs, Jains, Buddhists, Parsis and Christians, who came to India before December 31, 2014, from Pakistan, Bangladesh and Afghanistan. This law will remove legal barriers to resettlement and ensure a dignified life for refugees who have suffered for decades by providing citizenship. This law is for those who have suffered persecution for years and who have no other refuge in the world except India.

How to get Indian citizenship under CAA?

Under the CAA, people seeking Indian citizenship must have resided in the country for at least 12 months before the date of application. The rules state that applicants must have spent at least 6 years in the country during the 8 years immediately preceding these 12 months to be considered eligible to obtain Indian citizenship. According to the rules, applicants will also have to give a declaration that they are ‘irrevocably renouncing’ their existing citizenship and wish to make India their ‘permanent home’.
