6 rebel MLAs of Himachal approached the Supreme Court, challenged the Speaker’s decision – India TV Hindi

The Speaker has disqualified six Congress MLAs for violating the whip during the budget session of Himachal Pradesh Assembly. Now these 6 rebel MLAs have approached the Supreme Court. These Congress MLAs have challenged the Speaker’s decision to disqualify him. The Speaker had disqualified these MLAs on the basis of their absence during the budget in the Assembly. The MLAs have objected to this decision of the Speaker. The rebel MLAs have termed the Speaker’s decision wrong and demanded its cancellation.

Congress rebels Sudhir Sharma, Rajinder Rana, Inder Dutt Lakhanpal, Ravi Thakur, Devendra Bhutto and Chaitanya Sharma have filed a petition in the Supreme Court. The petition challenges the decision of Himachal Pradesh Assembly Speaker Kuldeep Singh Pathania, in which he has disqualified all these 6 Congress MLAs from membership of the Assembly. The Assembly Speaker has given this decision in his capacity as tribunal chairman.

Complaint was given to the Chairman

These MLAs, who lost membership under the anti-defection law, have challenged the decision to disqualify them. Harsh Vardhan Chauhan, Parliamentary Affairs Minister in the Himachal Pradesh Government and Chief Whip of the Congress Legislature Party, had submitted a complaint to the Speaker of the Himachal Pradesh Assembly. In this complaint, despite the whip being issued, all these 6 MLAs were said to be absent during the cut motion and budget passing. These MLAs marked their attendance in the attendance register of the Assembly, but were not present in the House at that time. While giving the verdict on this, the Speaker of the Assembly has declared him ineligible.

Expectation of relief from Supreme Court

These MLAs, who have been disqualified from being members of the Himachal Pradesh Legislative Assembly, say that the Speaker did not give them time to present their views. Apart from this, only one MLA received the notice, notice was not given to other MLAs. The MLAs’ lawyer also said that the Speaker took the decision as if everything written in the petition was true. Now these MLAs are expecting relief from the Supreme Court. If they do not get relief from the Supreme Court, then by-elections will be held in all these 6 assembly constituencies.
