CJI Chandrachud refuses to comment on criticism of the decision on Article 370

The Supreme Court had upheld the Centre’s decision to abrogate Article 370 of the Constitution, which gave special status to Jammu and Kashmir. This unanimous decision of the apex court was being criticized in some circles. Now Chief Justice DY Chandrachud has refused to comment on these criticisms. He has said that judges take decisions in any case according to the Constitution and law.

People can form opinions in a free society

Chief Justice DY Chandrachud, in an exclusive interview with PTI, said judges express their views through their judgments which become public property after the verdict. He said that in a free society people can always form their own opinion about it. Justice Chandrachud said that as far as we are concerned, we take decisions as per the Constitution and law. I don’t think it would be appropriate for me to respond to criticism or defend my decision.

After the judgment is pronounced, it becomes the property of the nation.

Chief Justice Chandrachud said that the judge hearing a case expresses his views through his decision. Once a judgment is pronounced, that judgment becomes the public property of the country. Until a decision is made, the process remains limited to the judges who are involved in the decision of that case. Once we reach a decision and the verdict is pronounced it is public property. This is the property of the nation. We are a free society. He said that we have a Constitution which protects the right to freedom of expression. Therefore people are entitled to exercise their right to freedom of expression.
