Jharkhand High Court, while giving its verdict in a recent hearing, has said that there is no need to provide concrete proof of marriage to a woman living with him as a wife to get maintenance. The court has said that in such a case when the evidence is present on record, there is no need to give concrete evidence. What is this whole matter?
In fact, the Family Court of Ranchi, while hearing a dispute case, had directed the husband to provide maintenance of Rs 5,000 per month to the wife. Husband Ram Kumar Ravi had challenged this decision of the Family Court in the High Court. The court reduced his monthly maintenance from Rs 5,000 to Rs 3,000 but rejected his petition. Let us tell you that the wife has alleged that the husband had got a government job in the disabled reservation category. After this the husband left her.
The court also mentioned marital relationship
Yesterday also, while hearing the matrimonial case, the Jharkhand High Court had quoted religious texts in its decision on the relationship between husband and wife. Justice Subhash Chand, in a 25-page order, cited Supreme Court judgments to express his views on how women in India come to live with their husband’s family after marriage. Justice Chand in his order also quoted quotations from Rigveda, Yajurveda, Manusmriti and also cited Teresa Chacko’s book ‘Introduction to Family Life Education’.
India is not like western countries
Justice Subhash Chand had said that in western countries the son gets separated from his family after marriage, but this is not the case in India. Citing a top court judgment, Justice Chand said a wife has to live with her husband’s family after marriage unless there is a strong justifiable reason for their separation.
