Talking about this, senior Supreme Court lawyer Uttara Babbar said that if we follow the law, then it is not necessary for Kejriwal to resign now. According to the law, disqualification can happen when someone has been proven guilty and has been sentenced.
The second question is that if he gets judicial custody, will Kejriwal be able to run the government from jail?
Responding to this, he said that in such a situation, the government can be run by the Chief Minister with the permission of the court, if the court feels that it is right. He further said that it is too early to say whether he will get it or not. This is in the provision of law and depends on the decision of the judge.
Can LG seek Centre’s intervention if constitutional work is not done?
Regarding this he said that I believe that the Center and the State have their own rights. This will not be easy to do. I didn’t think something like this couldn’t happen. I cannot say what will happen tomorrow but as of today it is not a completely broken down constitutional machinery. It would not be right to take this decision now. LG can do something like this when the government comes to a complete standstill. I don’t think there should be anything like President’s rule right now. There are many options now.
Suppose all the options of Kejriwal are closed then can he choose another leader?
Responding to this, he said that of course this can be done, but right now only people have been arrested. If we assume that all avenues are closed for Arvind Kejriwal, and Kejriwal does not get permission from the court to run the government from jail, then the party can take this decision.
