PIL canceling the appointment of Deputy Chief Ministers rejected – India TV Hindi

New Delhi: A PIL was filed in the Supreme Court of the country regarding the removal of Deputy Chief Ministers in the states. Hearing this petition, Supreme Court Chief Justice D.Y. Chandrachud said that a Deputy Chief Minister is first and foremost a minister in the state government and the post has no real connection in the constitutional sense.

Hearing the case, a bench headed by CJI DY Chandrachud said, “This is just a label. Even if you call someone Deputy CM, the constitutional status is that of a Minister only. The affiliation of a particular person to the post of Deputy Chief Minister has no real connection in the constitutional sense. They do not draw high salaries, they are like any other member of the Council of Ministers.”

Only provision for the post of Chief Minister in the Constitution

Whereas Justice J.B. Pardiwala and also Justice Manoj Mishra, said the petition challenging the appointment of Deputy Chief Ministers in state governments without making any provision for such appointments under the Constitution of India lacks substance and should be dismissed. The public interest litigation (PIL) filed by lawyer Mohan Lal Sharma said that Article 164 of the Constitution provides only for the appointment of Chief Ministers and the appointment of Deputy Chief Ministers has nothing to do with the citizens or public of the states.

What was said in the petition?

It said that the appointment of Deputy Chief Ministers creates confusion among the public at large and wrong and illegal precedents are being set by political parties by creating fictitious departments because Deputy Chief Ministers cannot take any independent decision, but they are given equal rights as Chief Ministers. Deputy Chief Minister in many states

Let us tell you that at present, Deputy Chief Ministers are appointed in most of the states of the country. Although this is not a constitutional post, it is considered to be politically satisfactory. It is noteworthy that he remains the Deputy Chief Minister in many other states including Uttar Pradesh, Maharashtra, Bihar, Rajasthan and Karnataka.
